An overwhelming majority of Australians have voted yes for same sex marriage. Even though this is yet to pass through parliament into law, there is a very good chance that same sex couples will be able to get married by the end of 2017. So how does this affect Australian immigration?
Partnership Visa
Migrants in a same sex relationship are currently eligible to apply for a Partnership Visa on the basis of a de facto relationship with an Australian citizen, Australian permanent resident or eligible New Zealand citizen. However, to be deemed to be in a de facto relationship the couple either must have lived together for a minimum of 12 months, or register their relationship under state law, which isn’t possible in all states. The proposed change in marriage law will enable same sex migrants to apply for a Partnership Visa on spousal grounds.

A free consultation is not available to you if you have already lodged a visa application, and the consultation will be cancelled. If you do not show up to your free consultation you can book another consultation for a fee of $165, as the time allocated to your free consultation will have already been utilised.
You can change the time of your free consultation more than 24 hours in advance of the scheduled consultation time at no extra cost. If you change the time of your consultation within 24 hours of the scheduled time a fee of $165 will apply, as we will not have had the opportunity to offer the free consultation time to someone else.
If you have already lodged a visa application or would like to book a follow up consultation after your free consultation, a fee of $165 will apply for a 30-minute consultation or $330 for a 60-minute consultation. An advice agreement will also need to be signed prior to any subsequent consultations.
